Terms and conditions of sale
APPLICABLE REGULATIONS: the sale of tourist packages, which concern services to be provided both nationally and internationally, is governed – until its repeal pursuant to Article 3 of Legislative Decree No. 79 of May 23, 2011 (the "Tourism Code") by Law No. 1084 of December 27, 1977, ratifying and implementing the International Convention on Travel Contracts (CCV), signed in Brussels on April 23, 1970, insofar as applicable, as well as by the Tourism Code (Articles 32-51) and its subsequent amendments.
PRICE: The price of the package tour may be changed up to 20 days before departure and only as a result of changes in: a) transport costs, including fuel costs; b) fees and taxes on certain types of tourist services such as taxes, fees, or landing, disembarkation, or embarkation fees at ports and airports; c) exchange rates applied to the package in question.
WITHDRAWAL BY THE TRAVELER BEFORE THE START OF THE PACKAGE:
the traveler may withdraw from the contract without
paying any penalty in the following cases:
– price increase exceeding 8%;
– significant change to one or more elements of the contract that can objectively be considered fundamental,
proposed by the organizer after the conclusion of the contract, but before departure and not accepted by the
tourist.
Travelers who withdraw from the contract for reasons other than those mentioned above, regardless of the amount
paid as a deposit, will be charged a withdrawal fee in accordance with Article 41 of the Tourism Code, calculated
based on the time of withdrawal, as follows:
10% of the participation fee for withdrawals up to 45 days before the departure date;
25% of the participation fee for withdrawal up to 30 days before the departure date;
50% of the participation fee for withdrawal up to 20 days before the departure date;
75% of the participation fee for withdrawal up to 8 days before the departure date;
No refund will be given after this deadline. In the case of non-catalog initiatives, the expenses referred to in Article 41 of the Tourism Code will be agreed upon each time upon signing the contract.
For some initiatives, the cancellation policy will have specific penalties and deadlines: in this case, they are specified in the offer email you received during the booking process.

For example:
for NAMTK-SAFTK-BTWTK-KZKTK vacations:
30% of the participation fee for withdrawals up to 45 days before the departure date;
80% of the participation fee for withdrawals up to 35 days before the departure date;
No refunds will be given after this deadline.
CATTK
30% of the participation fee for withdrawals up to 31 days before the departure date;
50% of the participation fee for withdrawals up to 16 days before the departure date;
75% of the participation fee for withdrawals up to 8 days before the departure date;
No refunds will be given after this deadline.
PNLTK/PNLWK
10% of the participation fee for withdrawal up to 60 days before the departure date;
30% of the participation fee for withdrawal up to 30 days before the departure date;
50% of the participation fee for withdrawal up to 15 days before the departure date;
75% of the participation fee for withdrawal up to 7 days before the departure date;
No refunds will be given after this deadline.
CANCELLATION OF THE TRIP BY THE ORGANIZATION:
The organizer may withdraw from the package travel contract and offer the traveler a full refund of the payments made for the package, but is not required to pay additional compensation if:
a) the number of people registered for the package is less than the minimum required by the contract and the organizer notifies the traveler of the withdrawal from the contract within the time limit set out in the contract and in any case no later than twenty days before the start of the package in the case of trips lasting more than six days, seven days before the start of the package in the case of trips lasting between two and six days, forty-eight hours before the start of the package in the case of trips lasting less than two days;
b) the organizer is unable to perform the contract due to unavoidable and extraordinary circumstances and notifies the traveler of the withdrawal from the contract without undue delay before the start of the package. The tourist may alternatively exercise the right to reclaim the amount already paid or to enjoy the offer of a replacement tourist package.
MEDICAL EXPENSES AND CANCELLATION INSURANCE
The participation fee INCLUDES Allianz Global Assistance health and baggage insurance for residents/domiciled in Italy.
It is also possible, at the time of booking, to choose a policy with more extensive coverage:
GLOBY ROSSO: If the basic health and baggage insurance already included in the price is not enough for you, choose the top coverage for travel assistance, medical expenses, and baggage, which INCREASES the coverage limits.
Want to protect yourself from the unexpected? When booking, you can also choose to take out insurance against penalties resulting from cancellation of your trip. There are two options:
GLOBY GIALLO: insurance that reimburses you for penalties applied in the event of cancellation. The insurance company will reimburse the penalties resulting from the customer's cancellation of the trip, net of any excess, if they are due to objectively documented events (e.g., pre-existing and chronic illnesses, work reasons, pregnancy, or illness of the customer's dog or cat, diagnosed pandemic illnesses, or acts of terrorism). The reimbursement ranges from 80% to 100% of the penalty, depending on the severity of the reason. Reimbursement is also provided in the event of rebooking the trip following a delayed arrival at the place of departure.
GLOBY VERDE: comprehensive coverage for your trip and your vacation! It includes protection in the event of cancellation, medical expenses during the trip (increased coverage compared to the basic policy included in the travel package), and reimbursement for any unused vacation time in the event of early return for serious medical reasons. The main guarantees of Globy Verde are also valid in the event of diagnosed pandemics, such as COVID-19.
Policies can be taken out by residents/domiciled in Italy.
Please note that we can issue these two cancellation policies ONLY IF the subscription and payment are made no later than 30 days before departure. For bookings made within 30 days of departure, the policy must be issued within 24 hours of booking.
Allianz Assistance will reimburse, in whole or in part, the penalties applied by Circolo Viaggi following cancellation by the customer, provided that the cancellation is due to serious and documented events that occurred after the booking was made, and only if communicated within 5 days of the day on which they occurred.
SHARED ROOMS: we offer the option of sharing rooms with people you do not know. Please note that if it is not possible to find a roommate before departure, you will be required to pay a single room supplement.
SUBSTITUTIONS AND CHANGES: the customer who withdraws may be replaced by another person provided that:
a) the organizer is informed in writing at least 7 working days before the date set for departure, receiving at the same time communication regarding the details of the transferee; b) the replacement meets all the conditions for using the service (Art. 39 of the Tourism Code) and, in particular, the requirements relating to passports, visas, and health certificates; c) the transferee reimburses the organizer for all expenses incurred in making the substitution, in the amount of €50 per person for weekly vacations and €30 for weekends of up to 3 nights. The transferor and the transferee are also jointly and severally liable for the payment of the balance of the price as well as the amounts referred to in letter c) of this article. In relation to certain types of services, a third-party service provider may not accept the change of name of the transferee, even if made within the deadline referred to in point a) above. The organizer shall therefore not be liable for any failure by third-party service providers to accept the change. Such failure to accept shall be promptly communicated by the organizer to the parties concerned before departure. The customer may also request a transfer to another holiday or another date, provided that this is communicated to the organization at least 4 weeks before the originally booked holiday and upon payment of a change fee of €50 per person for trips of 4 nights or more, €30 for trips of 2-3 nights.
COMPLAINTS AND CLAIMS: any failure in the performance of the contract must be reported by the consumer without delay so that the organizer, its local representative, or the tour guide can remedy it promptly. The consumer must, under penalty of forfeiture, file a complaint by sending a registered letter with acknowledgment of receipt to the organizer or seller no later than 10 working days from the date of return to the place of departure.
LIABILITY REGIME: the organizer is liable for damages caused to the tourist due to total or partial non-fulfillment of the services contractually due, whether these are performed by the organizer personally or by third-party service providers, unless the organizer can prove that the event was caused by the tourist (including initiatives taken independently by the latter during the performance of tourist services) or by the actions of a third party of an unforeseeable or unavoidable nature, by circumstances unrelated to the provision of the services provided for in the contract, by chance, by force majeure, or by circumstances that the organizer could not reasonably foresee or resolve, according to professional diligence.
OBLIGATION TO PROVIDE ASSISTANCE: The organizer is required to provide assistance to tourists in accordance with the criteria of professional diligence, with exclusive reference to the obligations incumbent upon them by law or contract. The organizer and the intermediary are exempt from their respective responsibilities (Articles 15 and 16 of these General Conditions) when the failure or incorrect execution of the contract is attributable to the tourist or depends on the actions of a third party of an unforeseeable or unavoidable nature, or was caused by unforeseeable circumstances or force majeure.
GUARANTEE FUND AND COMPULSORY CIVIL LIABILITY INSURANCE: (Art. 51 of the Tourism Code) The tourist packages sold under the contract governed by these general terms and conditions are covered by the following guarantee for the reimbursement of the price paid for the purchase of the tourist package and the immediate return of the tourist in the event of insolvency or bankruptcy of the intermediary travel agent or organizer, registered with Fondo di Garanzia Viaggi S.r.l. (www.garanziaviaggi.it ) with registered office in Rome, Via Nazionale 60 - Certificate no. A/180.173/5/2018/R for the purposes of the provisions of Art. 50, paragraphs 2 and 3, Legislative Decree 79/2011 and subsequent amendments
Circolo Viaggi is covered by RCT Unipol Assicurazioni policy no. 56783282 for civil liability.
JURISDICTION: Any disputes shall be settled by the court of the organization's registered office.
PRIVACY: Circolo Viaggi is the data controller. Pursuant to EU Regulation No. 2016/679 (GDPR), Circolo Viaggi is required to process data lawfully in order to ensure its security and confidentiality. Everyone has the right to know, update, supplement, correct, or delete their personal data in accordance with EU Regulation No. 2016/679 and national legislation on the protection of personal data.
